The UPC is the common patent court of the participating EU Member States and primarily hears cases concerning patent infringement and validity.
The case concerns a dispute over a European patent for a battery-powered parcel locker with prefabricated concrete foundations, enabling quick and flexible installation.
Drawing on his experience as a European Patent Attorney, Lasse R. Lauridsen primarily addressed the patent-related technical issues and the challenges to the validity of the patent. Mikkel Kleis dealt with the legal issues, including the interpretation of the patent claims and the question of patent infringement.
Patent Consultant Maria Laini has supported Lasse and Mikkel throughout the proceedings by conducting research and assisting with the preparation of written submissions, making her an important member of the team handling the case.
This was the third time that Lasse R. Lauridsen and Mikkel Kleis had appeared together at an oral hearing in a UPC case. Their previous UPC experience includes the first oral hearing before the Court’s Danish division, held on 28 November 2024. In that case, they represented a patent proprietor in proceedings concerning the review of an ex parte order to preserve evidence.
A multidisciplinary approach to complex patent disputes
UPC cases typically involve complex legal and patent-related technical issues. Patrade’s approach is therefore based on close collaboration between attorneys experienced in patent disputes and European Patent Attorneys with the necessary technical expertise and knowledge of patent law.
In the current case, this division of responsibilities made it possible to address patent validity, claim interpretation and infringement as interconnected aspects of the same dispute. The case also illustrates the importance of coordinating the legal and technical strategies from the very outset.
